BIGTRENDS.COM TERMS OF USE AGREEMENT
PLEASE READ THIS "TERMS OF USE" AGREEMENT CAREFULLY BEFORE USING ANY INFORMATION PROVIDED BY BIGTRENDS.COM.
BigTrends.com ("we", "us", "our", "BigTrends.com") provides investment information via its website ("Site", www.BigTrends.com), via email, via fax and in other formats. Any information or products or services you use from Big Trends.com are subject to your compliance with the terms and conditions set forth in this Agreement. By using our information, you agree to be bound by these terms and conditions. This Agreement is made between BigTrends.com and you, the user and/or member of the Site ("you"). We reserve the right at any time to: Change the terms and conditions of this Agreement; Change the Site, including eliminating or discontinuing any content or features on the Site; or Change any fees for use of the Site.
Code of Conduct. While using the Site you agree not to:
- Copy, frame or mirror any BigTrends.com information without our prior written authorization;
- Permit anyone else whose account or subscription was terminated, or who is not a BigTrends.com paid or trial subscriber, to use the Site through your subscription, username or password;
- Engage in spamming, flooding or hacking;
- Transmit any materials that contain any computer virus, worm, or other harmful or disruptive element;
- Modify, adapt, sublicense, translate, sell, reverse engineer or disassemble any portion of the Site;
- Remove any copyright, trademark, or other proprietary rights notices contained in the Site.
Registration for Subscriptions.
You must be 18 years of age or older to subscribe to any of our services. When you register to subscribe, you agree to (a) provide accurate information about yourself as prompted by the appropriate registration form, and (b) to maintain and update your information to keep it accurate, current, and complete.
You agree not to transfer or resell your use of or access to any information from BigTrends.com to any third party. If you are a BigTrends.com subscriber, and you have reason to believe that your online account is no longer secure, you must promptly change your password by updating your account information and/or immediately notify us by emailing us at: service@BigTrends.com.
Some of our subscription services involve email or fax transmissions as delivery methods. We assume no responsibility or liability for undelivered or late emails, whatever the reason may be. If you have problems getting your products delivered, contact our Customer Service department at service@bigtrends.com. We will make every effort to assist you in potential solutions that may fix delivery issues.
Payment and Renewal. Current subscriptions are available on BigTrends.com's Subscribe Online page. Payment for your subscription is due in advance of the subscription period you select. BigTrends.com does not automatically renew subscriptions unless you subscribe to the monthly autobill program for your convenience. The appropriate annual, quarterly, monthly, or similar periodic fee for your subscription will be billed at the beginning of your subscription period to the credit card you designate unless you notify BigTrends.com in writing that you do not agree to the Terms of this Agreement within 72 hours from the time of your receipt of this Agreement.
Cancellation Policy. Effective 09/07/07: You may cancel your subscription to BigTrends.com by notifying our Customer Service Department IN WRITING. Cancellations can be emailed to service@bigtrends.com, or faxed to 513-631-5039, or mailed to: BigTrends.com, 8030 Reading Rd., Suite 7, Cincinnati, OH 45237. Cancellation will take effect no later than 3 business days after we receive your notification. Monthly subscriptions will not be reimbursed or refunded. If services longer than one month in duration are purchased for the full list price (see full list prices below), then a pro-rata refund will be offered, based on the number of full months not used. Any pro-rata checks (for full list price payments only) will be mailed out within 4 weeks from the date of written cancellation. If a subscription longer than 1 month is purchased for less than the full list price, no refund will be offered. The remaining service time can be transferred to another service of equal or lesser value. If you have questions about how much time you have remaining in your subscription, email us at service@bigtrends.com. Educational items, including but not limited to: books, CD ROM's, DVD's, and videos are not refundable.

Termination. This Agreement shall remain effective until terminated in accordance with its terms. BigTrends.com may terminate this Agreement, and/or your access to and use of the Site or any portion thereof, immediately, in the event we determine, in our sole discretion, that you have breached this Agreement. In addition, we reserve the right, upon 10 business days' notice and the reimbursement of any monies due according to the cancellation policy above, to terminate this Agreement without cause.
Ownership and Restrictions on Use. . ©2005 BigTrends.com. All Rights Reserved. The Site is owned and operated by us in conjunction with others pursuant to contractual arrangements. You may only access and use the materials on the Site, and download and/or print out only one copy of any materials on the Site, solely for your personal use. You may not republish, upload, post, transmit or distribute materials from BigTrends.com in any way without our prior written permission. Modification of the materials or use of the materials for any other purpose is a violation of our copyright and other proprietary rights, and is strictly prohibited. You acknowledge that you do not acquire any ownership rights by using information from BigTrends.com. "BigTrends.com" and the BigTrends.com logo are trademarks and/or service marks of BigTrends.com. You acknowledge and agree that we shall not be held responsible for the legality, accuracy, or inappropriate nature of any content, advertising, products, services, or information located on or through any other websites, nor for any loss or damages caused or alleged to have been caused by the use of or reliance on any such content.
DISCLAIMERS. UNDER NO CIRCUMSTANCE ARE BIGTRENDS.COM, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS LIABLE FOR ANY INCIDENTIAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES OF ANY NATURE WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH PROVIDING OR FAILING TO PROVIDE SERVICE, INCLUDING, WITHOUT LIMITATION, LOST PROFITS OR LOSS OF BUSINESS. THIS SECTION SHALL ALSO SURVIVE THE TERMINATION OF THIS AGREEMENT. Your sole remedy for dissatisfaction with the Site and/or content contained within the Site is to stop using the Site or other information from BigTrends.com. The sole and exclusive maximum liability to the company for all damages, losses, and causes of action (whether in contract, tort (including, without limitation, negligence), or otherwise) shall be the total amount paid by you, if any, to access the Site or its contents.
Indemnification. You agree to indemnify, defend and hold us, our officers, directors, employees, agents and representatives harmless from and against any and all claims, damages, losses, costs (including reasonable attorneys' fees), or other expenses that arise directly or indirectly out of or from (a) your breach of this Agreement, including any violation of the Code of Conduct above; or (b) your activities in connection with the Site or any services related to the Site. This indemnification extends to and includes any attorney's fees and costs incurred by us arising from any action or claims to which this indemnification applies, or from the contesting of the applicability of this provision. This section survives termination of this Agreement.
THIS AGREEMENT IS GOVERNED BY AND MUST BE CONSTRUED UNDER THE LAWS OF THE STATE OF KENTUCKY, WITHOUT REGARD TO CHOICE OF LAW PRINCIPLES. YOU AGREE TO SUBMIT YOURSELF TO THE PERSONAL JURISDICTION OF THE COURTS IN THE STATE OF KENTUCKY.

If any part of this Agreement is held invalid or unenforceable, that part is interpreted consistent with applicable laws as nearly as possible to reflect the original intentions of the parties and the rest of this Agreement remains in full force and effect. BigTrends.com and its officers and employees are not registered investment advisors or broker/dealers. We are purely a research organization, seeking to provide unbiased information for educational purposes only. Readers are advised that the commentary and reports on its website and in its newsletters are issued solely for information purposes and should not to be construed as an offer to sell or the solicitation of an offer to buy any security.
